Submit a declaration of compliance in accordance with Section 92 (2) of the Building Energy Act for existing buildings


The Building Energy Act (GEG) sets requirements for the energy performance of buildings. The client or owner of a heated or cooled building must prove that the building meets the requirements of the Building Energy Act.

In the case of extensions and expansions as well as certain changes to buildings, the building owner must provide evidence of compliance with the requirements of the GEG. Proof of compliance with the requirements is provided in the declaration of compliance (Section 92 (2) GEG). The declaration of compliance must be submitted within 3 months of completion of the construction project.

Requirements

You must confirm that the requirements of the Building Energy Act (GEG) are met when extending, expanding or modifying the building if you extend or expand the building to include heated or cooled rooms (Section 51 GEG). You must also submit a declaration of compliance for changes for which calculations have been carried out for the entire building (§ 48 Para. 1, 50 Para. 1 to 3 GEG).

In these cases, the declaration of compliance may be issued by persons who are authorized to issue energy performance certificates in accordance with § 88 GEG.

You must submit the declaration of compliance in accordance with the model published by the Senator for the Environment, Climate and Science pursuant to Section 2 (1) (2) or (3) GEGV.

What documents do I need?

  • Fully completed declaration of fulfillment (Section 92 (2) GEG)
    • if applicable, a copy of the calculations for the entire building prepared in accordance with § 50 of the Building Energy Act (§ 93 GEG)
    • if applicable, a copy of the calculations for the heated or cooled rooms to be added in order to comply with the requirements in accordance with Section 51 of the Building Energy Act and, in the cases of Section 51 (2) of the Building Energy Act, the calculation for summer heat insulation (Section 93 GEG) and
    • if applicable, a copy of the energy certificate (§ 80 GEG).
