If you plan to remediate a contaminated site or harmful soil change, you must report this measure to the responsible soil protection authority.
Basic information
Remediation measures
- to remove or reduce the pollutants (decontamination measures),
- which prevent or reduce the spread of pollutants in the long term without eliminating the pollutants (containment measures),
- to eliminate or reduce harmful changes in the physical, chemical or biological properties of the soil
- must, under certain conditions, be notified to the authorities in writing as early as possible before they are carried out in accordance with Section 3 (4) BremBodSchG. The Soil Protection and Contaminated Sites Department of the Senator for the Environment, Climate and Science or the Environmental Protection Office at Bremerhaven City Council are available for this purpose.
Requirements
Remediation measures must be reported if
- they are not carried out by order of the competent authority (see §§ 10 and 16 of the Federal Soil Protection Act) or
- they are not based on an official remediation plan (see § 13 Paragraph 1 of the Federal Soil Protection Act).
According to §4 of the Federal Soil Protection Act, the following must be notified in particular
- polluter of a harmful soil change or contaminated site
- Property owner
- holder of the actual power over a plot of land
- Building owner
