With the Prostitute Protection Act, an official registration obligation was introduced for prostitutes on 01.07.2017. The perception of an information and counseling interview and a health consultation is mandatory as part of the registration procedure.
Basic information
The aim of the Prostitution Protection Act is to provide better protection against human trafficking and forced prostitution and to improve the situation of women and men engaged in prostitution - in particular by sustainably strengthening access to support and counseling services. The practice of prostitution itself will continue to be exempt from licensing.
Prostitutes must register their activity, the provision of sexual services for remuneration. Not sexual services are performances of a primarily performing nature in which no other of the persons present is sexually actively involved. Such persons are not required to register.
Anyone wishing to engage in an activity as a prostitute or as a prostitute must register this personally with the authority in whose jurisdiction the activity is to be primarily carried out before commencing the activity.
The obligation to register exists regardless of whether the activity is carried out independently or as part of an employment relationship.
Requirements
Anyone wishing to work as a prostitute or prostitute must attend a health consultation. The prostitutes must prove that they have taken advantage of the health consultation by presenting a certificate when registering. In the municipality of Bremen, the Senator for Economics, Labor and Ports - Department of Trade Affairs - (trade authority) is responsible for the registration procedure.
A certificate (registration certificate) is issued on the registration.
The registration is linked to a personal information and consultation meeting.
In addition to the registration certificate and the health consultation certificate with the name, it is possible to issue a so-called alias registration certificate or alias health consultation certificate. The real name is replaced by an imaginary name. The alias name can be freely chosen and does not have to indicate gender.
The alias name of the certificate of registration must be identical to the alias name of the certificate of health consultation.
The alias name does not have to be identical to the work name.
The alias certificate allows prostitutes - without giving up anonymity - to inform about their proper registration as a prostitute.
Alias certificates (alias registration certificate and health consultation certificate) can be used by prostitutes towards operators. The real name does not have to be provided. This allows prostitutes to decide whether they want to give their real name to the operator or to persons acting on their behalf. Agreements with operators of a prostitution business can also be concluded under the alias name resulting from the valid alias registration certificate.
The alias certificate also serves as proof during inspections by the registration and licensing office (in Bremen, this is the Trade Licensing Office).The registration and alias certificate is not, however, a substitute for the identity card or passport.The prostitute must state all countries and/or municipalities in which he/she plans to practice prostitution when registering. Failure to comply with the registration requirement may result in significant consequences. If prostitutes are not registered, they are not/no longer allowed to work in a prostitution establishment. Operators are obliged to ensure that the persons working for them are registered.
In the event of a lack of registration, fines of up to 1,000 euros may be imposed at the discretion of the trade authority responsible in Bremen.
Prostitutes working with other prostitutes must note that a permit is required to operate a prostitution business if they share a house, apartment or apartment. According to Section 2 (3) of the Prostitution Protection Act, anyone who provides premises for this purpose that are used for the provision of sexual services also operates a prostitution trade.
