Permission to set up playground equipment with the possibility of winning

Anyone wishing to set up gaming machines on a commercial basis which are equipped with a technical device that influences the outcome of the game and which offer the possibility of a prize requires a permit in accordance with Section 33c of the Trade, Commerce and Industry Regulation Act (Gewerbeordnung).

The permit only authorizes the installation of gaming machines whose design has been approved by the Physikalisch-Technische Bundesanstalt. It may be subject to conditions, also with regard to the place of installation, insofar as this is necessary for the protection of the general public, guests or residents of the respective premises or neighboring properties, or in the interest of the protection of minors. For the same purpose, the subsequent inclusion, amendment and supplementation of conditions is also permissible.

Requirements

A permit pursuant to Section 33c of the German Trade, Commerce and Industry Regulation Act (Gewerbeordnung) requires that the person setting up the display be reliable under trade law.

What documents do I need?

• Completed application form (printout under Forms)
• Identity card or passport with a current registration certificate
  

  in the case of representation with written power of attorney: identity card or passport of the authorised representative, as well as a copy of the identity card of the principal

• Certificate in tax matters of the tax office
  

  (to be applied for at the tax office of the place of residence)

• Information from the insolvency court as to whether proceedings have been opened
  

  (to be applied for at the district court of the place of residence)

• Certificate of good conduct in document type OG (for submission to an authority)
  

  (to be applied for at the local registration office responsible for your residence)

• Information from the central trade register in document type 9
  

  This can be applied for via the trade registration office. The Senator for Economics, Ports and Transformation -Commercial Affairs-, Katharinenklosterhof 3, 28195 Bremen should be specified as the recipient when applying.

  If a legal entity is planned as the operator, information for this legal entity and the entire management is required.

• Social concept
  

  For a permit to set up playground equipment with the possibility of winning, a social concept must be submitted in accordance with § 33c paragraph 2 of the Trade, Commerce and Industry Regulation Act. The social concept describes the measures to prevent the socially harmful effects of gambling.

• Certificate of instruction in player and youth protection
  

  According to § 33c of the German Trade Regulation Act (Gewerbeordnung), a certificate from the Chamber of Industry and Commerce is required to prove that one has been instructed in the knowledge necessary for the exercise of the trade.
